DMCA & Intellectual Property Policy
Last Updated: October 2026
At Berkshirelegwear (accessible via https://berkshirelegwear.com), this policy explains who owns the content on this site, what you may do with it, and how we handle a claim that something here infringes someone else's copyright or trademark.
Product photographs and descriptions are what let you judge a pair of pants from a screen, and they take work to make. We respect the rights of others in the same way we ask others to respect ours, and we act quickly on a valid notice.
By using our website, you agree to the terms below. If a question about content or rights is not answered here, email us at [email protected] and we will be glad to help.
Intellectual Property at a Glance
| Item | Details |
|---|---|
| Site content | Owned by Berkshirelegwear or used with permission |
| Personal use | Viewing and printing for yourself is allowed |
| Infringement notices | Email [email protected] with the six items listed below |
| Response time | Acknowledged within 2 business days |
| Counter-notices | Accepted under Section 512(g) |
1. Ownership of Site Content
The text, product photographs, graphics, page layout and the name Berkshirelegwear are owned by us or licensed to us. They are protected by United States copyright and trademark law.
2. Limited Permission for Personal Use
You may view pages, save a product photo to compare at home, and print a page for your own reference. You may not copy listings, photographs or text onto another site or marketplace, or use them commercially, without our written consent.
3. Respect for Third-Party Rights
We do not knowingly list items, photographs or descriptions that infringe anyone else's rights. If something on the site does, we want to hear about it, and we remove or correct material that a valid notice identifies.
4. Sending a DMCA Notice
If you believe content on this site infringes a copyright you own or represent, email [email protected] with the following:
- A physical or electronic signature of the copyright owner or a person authorized to act for them.
- Identification of the copyrighted work you believe has been infringed.
- Identification of the material on our site you believe is infringing, with the page address, so we can find it.
- Your contact details: name, mailing address and email address.
- A statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
5. What Happens Next
We acknowledge a complete notice within 2 business days, remove or disable the material identified, and tell the person who posted it, if that was not us, what has been removed and why. An incomplete notice is answered with a request for the missing items.
6. Counter-Notice
If material you posted was removed and you believe that was a mistake, email [email protected] with:
- Your physical or electronic signature.
- Identification of the material removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, mailing address and email address.
- A statement that you consent to the jurisdiction of the federal court for your address, or for Litchfield County, Connecticut if you are outside the United States.
- A statement that you will accept service of process from the person who sent the original notice.
We forward the counter-notice to the original complainant and may restore the material in 10 to 14 business days unless they tell us they have filed a court action.
7. Repeat Infringers
Anyone who repeatedly posts infringing material through any part of this site has that access ended.
8. Misrepresentation
Under Section 512(f) of the Copyright Act, a person who knowingly misrepresents that material is infringing, or was removed by mistake, may be liable for damages, including the costs of the party harmed by the misrepresentation.
9. Changes to This Policy
Updates are posted here with a new date at the top.
